Welcome to Handy Painter's online platform. By accessing our website and using our services, you agree to be bound by the following Terms of Use. Please read them carefully.

**Modification of Terms**

Handy Painter ("we," "our," or "us") reserves the right to update or modify these Terms of Use at any time without prior notice. Your continued use of our website and services after such changes indicates your acceptance of the revised terms.

**Terms & Conditions**

These terms and conditions are confidential and are intended solely for the "client." They should not be shared with any third parties.

**1. Definitions**

In this agreement:

- "We," "our," or "us" refers to Handy Painter or Bujar Kurtaj.

- "You" or "property owner" refers to the client/customer or any party contracting our services.

**2. Quotations**

We strive to provide accurate quotes within 7 days of receiving your request. It's your responsibility to ensure accurate information for timely responses.

Our quotes are valid for 30 days from receipt, unless otherwise agreed.

Quotes are non-negotiable unless we choose to offer a discount.

Acceptance of our quotes implies agreement to our terms and conditions.

All prices quoted are in Australian dollars and exclude GST.

**3. Timings**

We endeavor to adhere to agreed timelines, weather permitting.

Timings are subject to weather conditions and unforeseeable circumstances.

We are not liable for any time-related losses due to contract timings.

Deposits are required upon agreeing to a start date.

Failure to return signed contracts and pay deposits may result in canceled start dates.

**4. Weather Conditions**

Adverse weather may lead to contract postponement.

Start dates and project completion are weather-dependent.

We do not work in weather unsuitable for painting preparation/application.

**5. Deposits**

Deposits of 15%-30% (Contract Value $5-10K) or 35%-50% (Contract Value $15-$20K) are required upon start date confirmation.

Deposits are non-refundable under any circumstances.

Smaller deposit amounts may be considered at our discretion.

**6. Warranties/Guarantees**

We offer a minimum 1-year warranty on workmanship and products used.

Property owners must conduct regular maintenance for warranty validity.

Warranties are void if work is altered by property owner or third parties.

Warranty claims must be submitted in writing.

We cover paint and product costs for valid warranty claims; labor costs are not included.

Certain substrates and issues are not covered by warranties.

**7. Paint Products**

We may change products without notice.

Paint and materials remain our property until all balances are paid.

Unused paint may be removed from project sites.

Color choices are the client's responsibility; costs for changes are borne by the client.

Yellowing of gloss enamel products is not our responsibility.

Supplier price increases may be passed on to clients.

**8. New Homes**

We require operational internal lighting before painting new homes.

Limitations on filling surfaces and responsibility for gaps apply.

We do not commence until other trades have completed their work.

We are not liable for damage caused by other trades during painting.

**9. Invoices**

Invoices must be paid on completion.

Progress payments may be requested during projects.

Late payments may incur interest and debt collection costs.

**10. Warranty**

We follow recommendations of building services board for warranty issues.

Issues beyond our control may result in client responsibility for costs.

**11. Complaints**

Complaints must be submitted in writing within 7 days.

Confidentiality is expected; public complaints may lead to legal action.

**12. Additional Work**

Unspecified work is charged at our hourly rate.

Clients should inform us of any discrepancies in the quote.
